Yep, poor boy was a model citizen, just feeling entitled to pack of cigars. Might as well use your size to intimidate a guy half his size to get what he wants. I'm sure he was just as nice and polite and respectful to the police officer.
I wonder, if any of us had been the clerk, instead of trying to confront the big lug, would we stay behind the counter, and cover him with our firearm, and ask him to put the stuff back, and if he didn't, and got in our face like that, would we be justified in firing on him? I would not have got out from behind the counter to confront some big lug like that. That seems to just be asking for trouble. I would stay behind the counter, but have a pistol out of his sight trained on him. I'm pretty sure you'd be up on murder charges if it was just a case of shop lifting, but if he got in your face and threatened you, that's a whole 'nother deal. In most convenience stores I've been in, all the tobacco, is behind the counter to prevent minors from accessing them, so did he go behind the counter and grab them? If someone was coming behind the counter, I think I'd feel threatened, just due to the size disparity. Tough decisions would have to be made in an instant. How would you know if he was just going to grab some cigars, or head on over and try and empty the cash register? I'd say anyone coming behind the counter, had crossed a boundry, and I would be feeling like my life was in danger.
